High Court in Masindi has released the attachment of the contested land at Nyairongo Village in Kaseeta Parish, Kabwoya Sub-county in Buhaguzi County, Hoima District.
Kabwoya is currently in Kikuube, the district that was carved out of Hoima before the case was filed.
This follows a disagreement among residents over ownership of the land in contention after receiving a certificate of title to the land.
One of the respondents, Balak Ampire, wanted to evict the entire community from that piece of land claiming that it belonged to him after obtaining a court order to the effect.
However, the community of approximately 500 households sought assistance from the Civic Response on Environment and Development (CRED) after realising that they could not meet all the requirements needed to pursue the case in court.
With such a help, CRED represented the community with the High Court Assistant Registrar, Simon Kintu Zirintusa, releasing the attachment of “the decreed land in Civil Suit No.16 of 2015 measuring approximately 500 acres.”
In the order dated Tuesday, May 25, 2021, Mr Zirintusa also said the warrant to give vacant possession of the property has been set aside with each party bearing its own costs of the application.
The complainants in the suit included Richard Kiwanuka, Tapier Okumu, Felix Akankwasa, Lovinsa Namatovu and Gerald Tusabomu while the respondents were Ampire and Baker Twesigye.
